Here are a few tips on how to minimize pothole problems:

  • Keep tires properly inflated
  • Leave extra space between you and the car in front of you, and look further down the road
  • Slow down if you see cars ahead swerving
  • Watch for puddles which can conceal deep potholes
  • If you have to drive over a pothole, slow down by braking gently before you hit it
  • Don't speed or brake over a pothole; you can seriously damage your car

THE LAWS ON POTHOLES, STREETS, SNOW and ICE

State Law RSA 231:90-93 (Revised Statute Annotated) states the following:

In accordance with RSA 231:90-93, the City of Dover is not liable for damages

caused by an insufficiency unless they received prior notice of such insufficiency

and failed to act within a reasonable period of time.

The City of Dover relies on the statutory immunity afforded to it under RSA 231:90-93 which in part states:

I. A municipality shall not be held liable for damages in an action to recover for personal injury or property damage arising out of its construction, maintenance, or repair of public highways and sidewalks constructed thereupon unless such injury or damage was caused by an insufficiency, as defined by RSA 231:90, and:

(a) The municipality received a written notice of such insufficiency as set-forth in RSA 231:90, but failed to act as provided by RSA 231:91;...
