The Secretary of State is a constitutional officer, elected every two years by the legislature. The position is third in line in succession to be Acting Governor following the Senate President and Speaker of the House if the Governor is incapacitated or the office becomes vacant.

Scanlan was first elected in Dec. 2022 but became Acting Deputy Secretary of State in January 2022 when Bill Gardner appointed him following his resignation after 45 years in the position. Scanlan was also elected to the House Representatives from 1984 to 2002, serving the last two years as majority leader.
