Committee Purpose

RESOLUTION RE: DELEGATION OF WATERFRONT REDEVELOPMENT UNDER NH RSA 205

WHEREAS: The Cochecho Waterfront Advisory Committee appointed in April 2004 has now completed its research and has recommended the Council transfer authority to develop the land to an agency that is legally empowered to oversee the project; and

WHEREAS: The Dover Housing Authority is an established agency under RSA 203 that is legally empowered to undertake redevelopment projects of vacant and blighted properties; and

WHEREAS: Pursuant to RSA 205:4, the Council may delegate authority to oversee a redevelopment project.

WHEREAS: A charette report, containing the project vision, goals, and design guidelines has already been drafted by the Cochecho Waterfront Advisory Committee; and

WHEREAS: An advisory board made up of members in accordance with RSA 205:9 will coordinate activities with the Dover Housing Authority; and

WHEREAS: No City funds will be conveyed by the Dover Housing Authority in such a way that the goals outlined in the charette report may be achieved and the City realizes a return in tax revenues and public improvements; and

WHEREAS: No City funds will be obligated for this redevelopment project unless approved by the City Council excepting the City Manager may make City staff and services available to the Advisory Board on an as needed basis; and

WHEREAS: It is expected that the City-owned property along the waterfront shall be conveyed by the Dover Housing Authority in such a way that the City realizes a rate of return in public improvements and infrastructure that is comparable to the assessed value; and

WHEREAS: The advisory board shall be made up as follows; Mayor, Executive Director of Dover Housing Authority, and City Manager designee shall serve in a non-voting ex-officio capacity. The Mayor shall appoint a chair and nine other members. Initial appointments shall be as follows: 3 members for three (3) year terms; 3 members for four (4) year terms; and four members for five (5) year terms. Subsequently, all appointments shall be for three (3) year terms. The Chair of the committee has the discretion to appoint two additional board members.

WHEREAS: The City Manager will make City staff and services available to the Advisory Board on an as needed basis.

NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND DOVER CITY COUNCIL THAT:

A Waterfront Redevelopment Advisory Board shall be established in accordance with the provisions of RSA 205 and will consist of nine members recommended by the Mayor, with Council approval and an additional three members as approved by the Chair of the Advisory Board. 4 members will be designated to serve an initial 3 year term; 4 members will be designated to serve an initial 4 year term; and 4 members shall be designated to serve an initial 5 year term. Thereafter all members will be recommended by the Mayor, with Council approval, to serve a 3 year term; The Mayor, Executive Director of Dover Housing Authority or designee, and City Manager or designee will serve in a non-voting ex-officio capacity

AND FURTHER BE IT RESOLVED THAT:

In accordance with the provisions of RSA 205, the Dover Housing Authority is hereby delegated the task of redevelopment of the Cochecho Waterfront in accordance with the proposed design charette and will further coordinate the project with an advisory board appointed as set forth above.
